Terms and Conditions for DABUR HERBAL CONTEST
1. Introduction:
The "Dabur Herbal Contest" (hereinafter referred to as the "Offer") is organized by Dabur India Limited, having its registered office at 8/3, Asaf Ali Road, New Delhi 110 002, India, (hereinafter referred to as "Dabur"). By participating in this Offer, you agree to comply with these Terms and Conditions (hereinafter referred to as "T&Cs"). Please carefully read and understand these T&Cs before participating in the Offer.
2. Offer Period:
This Offer shall be effective from 1st July, 2024 to 30th August, 2024 (05:00 PM).
3. Eligibility:
a. To be eligible to participate in the Offer, the participant (hereinafter referred to as “You”) must meet the following criteria:
i. You must be a natural person.
ii. You should be an individual legal resident of Kerala and citizen of the Republic of India
iii. You must have attended the age of 18 years.
iv. You shall be legally competent to enter into a binding contract under the applicable laws of India.
b. Employees of Dabur, their immediate family members (spouses, domestic partners, parents, grandparents, siblings, children, and grandchildren), and Dabur's affiliates, advisors, advertising/Offer agencies, and execution partners are not eligible to participate in the Offer.
c. Dabur reserves the right to exclude or disqualify any person from the Offer on grounds of:
i. Misconduct or criminal record or acting or having the intention to act in a dishonest or fraudulent manner or in bad faith.
ii. Tampering with the entry process or the operation of the Offer.
iii. Acting in violation of these T&Cs.
iv. Entries being offensive, distasteful, unacceptable, or against the ethos and principles of Dabur or which may be considered disparaging.
v. For any other reasons deemed fit and proper by Dabur.
4. Details of the Offer and How to Enter:

5. Additional Terms:
a. Dabur may, at its sole discretion, change the T&Cs or cancel the Offer at any time, or modify, terminate, or suspend the Offer for any reason whatsoever with/without notice to you, including the reason due to viruses, worms, bugs, unauthorized human intervention, or other causes beyond Dabur's control that corrupt or impair the administration, security, fairness, or proper play of the Offer or submission of entries. No claims or questions shall be entertained in this regard.
b. By entering into this Offer, you hereby release Dabur and/or its business Partner from any kind of claims and agrees to indemnify Dabur and/or its Business Partner and any of their respective officers/employees/directors/representatives/ agents from and against all liability, cost, loss, or expense arising out of acceptance of the Offer or participation in the Offer, including (but not limited to) personal injury and damage to property or any violation of intellectual property rights of a third party or any law and whether direct, indirect, consequential, foreseeable, due to some negligent act or omission, or otherwise.
c. Dabur and its Business Partner accept no liability, whether jointly or severally, for any errors or omissions, whether on behalf of itself or third parties, in relation to the Offers.
d. Dabur and/or Business Partner will not be responsible for:
i. Any SPAM-generated messages.
ii. Any SMS/WhatsApp or other messaging service message delivery failures.
iii. Lost, misdirected, late, incomplete, or unintelligible entries or inaccurate entry information, whether caused by You or by any of the equipment or programming associated with or utilized in the Offer, or by any technical or human error that may occur in the processing of entries.
iv. Any printing or typographical errors in any materials associated with the Offer.
v. Any error in the operation or transmission, theft, destruction, loss, unauthorized access to, or alteration of, entries, or for technical, network, telephone, computer, hardware or software malfunctions of any kind, or inaccurate transmission of, or failure to receive any entry information on account of technical problems or traffic congestion on the internet or at any website.
vi. Injury or damage to Your or any other computer or mobile resulting from downloading/scanning any materials in connection with the Offer.
vii. If you do not have mobile phones or other gadgets or means that support the Offer link/technical requirements.
viii. If you have registered himself/herself to the DND of the telecom provider/the Participant has registered with the National Do Not Call Registry/Participant has specifically requested not to receive messages for the specific Offer/Offers.
ix. Other conditions beyond Dabur’s or its Business Partner's reasonable control or any Force Majeure Event. The Participant putting a missed call under the terms of this Offer is deemed to be express consent on the part of the Participant to exempt Dabur and Business Partner from DND restriction imposed by the relevant Participant.
e. Any attempt to deliberately damage any Dabur website or the Business Partner's Offer website or the information on the website, to cause malicious damage or interference with the normal functioning of the website, or to otherwise undermine the legitimate operation of this Offer may be a violation of criminal and civil laws. If Dabur incur any costs in connection with any breach of these T&Cs or any other legal obligation by Participant, the Participant agrees to indemnify Dabur or our Business Partner/s for those losses, damages, and costs.
f. Dabur, in our sole discretion, reserves our right to exclude you/participants from the Offer and/or not to attribute the Offer, and/or to cancel all or part of the Offer, without any liability on our part, if Dabur believes You/participant have:
i. Breached any of these T&Cs.
ii. Acted or have the intention of acting in a dishonest or fraudulent manner, or in bad faith.
iii. Tampered with the entry process or the operation of the Offer.
iv. Acted in an unsportsmanlike or disruptive manner or with intent to annoy, abuse, threaten, or harass any other person.
g. Dabur and/or Business Partner are not responsible for any problems or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a mobile network, or any combination thereof, or any other technical failures including any damage to entrant's or any other person's mobile handset or computer related to, or resulting from, participation in this Offer or the downloading of any materials related to this Offer.
h. If this Offer is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of Dabur, including but not limited to technical difficulties, unauthorized intervention, or fraud, Dabur may, in addition to its other rights, reserve the right, in its sole discretion, to the fullest extent permitted by law: a. To invalidate any Participant. b. To modify, suspend, terminate, or cancel the Offer, subject to any written directions from a regulatory authority.
i. If for any reason this Offer is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorized intervention, technical failures, or any other causes beyond the reasonable control of Dabur and/or Business Partner which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Offer, Dabur reserves the right in its sole discretion to cancel, terminate, modify, or suspend the Offer, subject to any written directions made under applicable state or territory legislation.
j. Dabur and/or Business Partner and/or their respective affiliates, and their officers, directors, employees accept no liability and shall not be responsible and/or liable in any manner whatsoever in case the Participant is unable to submit his/her entry for any reasons whatsoever, including due to failure on the part of the telecom operator, facility provider, internet issues, device compatibility, capacity constraints, etc.
k. All attempts will be made by the Business Partner to protect the data submitted to it by a Participant from loss and corruption, but in the event such data loss happens, Business Partner may have to continue with whatever data is available, or in any other manner as it may deem reasonable. Dabur and/or the Business Partner should not be held responsible for any loss of data or the action taken on account of the same. Dabur and/or Business Partner and/or their respective affiliates, their respective officers, directors, employees will not be held responsible to make good any such loss or dissatisfaction on account of such loss.
l. Business Partner will take reasonable efforts to ensure that there is no security breach at its end in the course of the conduct of the submission of entry for the Offer and/or that there is no data/entry loss and/or any other loss at its end. However, in the event of a security breach and/or data/entry loss and/or any other loss for any reasons whatsoever, Dabur and/or Business Partner and/or its affiliates, their respective officers, directors, employees shall not be responsible or liable in any manner whatsoever for any loss on account of any such instances as may be sustained by the Participant. Dabur and/or Business Partner and/or its affiliates, their respective officers, directors, and employees shall have the right at all times to exclude or disregard any entries submitted during any period where a security breach or data/entry loss or any other loss occurs.
m. In no event, Dabur and/or its Business Partner shall be held liable for any issues relating to the redemption of the voucher including redemption request not being honored by Payment processing partner.
6. Miscellaneous:
a. This Offer is being made purely on a "best effort" basis, and participation in this Offer is at your sole discretion and on a voluntary basis.
b. If there are any Government restrictions imposed on the movement of people, operation of outlets, transportation, or any other aspect that may impact the operation of the Offer as usually planned, Dabur and the Business Partner cannot be held liable due to such restrictions, including for inability to provide the Offers or changing the Offers due to such restrictions. Any delay or inability to operate the Offer in that regard will be treated as a Force Majeure Event (defined below). In the event of any directions of the Government applicable for consumers/Participants/Offer Winners, You shall ensure due compliance to the same, and Dabur and/or the Business Partner cannot be held liable for any non-compliance in that regard.
c. You agree that all decisions related to the Offer made by Us are final and binding on You. Failure by Dabur and/or Business Partner to enforce any of these T&Cs in any instance shall not be deemed to be a waiver of the T&Cs and shall not give rise to any claim by any person.
d. We will not be liable for any costs incurred by You in connection with Your participation in the Offer. Announcements and information about the Offer shall be posted on the same page where these T&Cs are posted.
e. For any disputes, complaints, queries pertaining to this Offer (defined below), please reach out to us or our Business Partner namely Premier Sales Promotions Pvt Ltd, Mitra Towers, Kasturba Road, Bangalore 560001, India. E-mail: feedback@bigcity.in. Failure to do so will be tantamount to the expiry of any claims in connection with the Offer submitted by a person. For any complaints and grievances relating to Offers provided by any of our Business Partners, Dabur will not have any liability or responsibility regarding the same.
f. If You are dissatisfied with the Offer or any aspect of the Offer including the Offer rules, any content, any requirements of the Offer form, the materials available related thereto, these T&Cs, etc., Your sole and exclusive remedy is to not participate in the Offer.
g. In no event shall the maximum liability Dabur and/or its Business Partner exceed the value of the voucher as the case may be.
7. Intellectual Property Rights:
a. All rights, titles and interests, including but not limited to the intellectual property rights, in the promotional material(s) and all Offer-related material including those submitted by Participants shall vest solely and exclusively with Dabur at all times. Dabur or any person or entity permitted by Dabur in this regard shall be entitled to use the responses/material or any information in connection with the entry, received in any medium whatsoever, for all its future promotions, marketing, publicity and/or any other purpose, without any permission and or payment to the Participant.
b. If any material is submitted in connection with the Offer (whether written, audio, electronic or visual form, or a combination of those) or any photographs, video and/or film footage and/or audio recording are taken of the Participants, the same are assigned to Dabur upon submission and become the property of Dabur exclusively. Dabur and/or the Business Partner, on Dabur’s written instructions, may use the material in any medium in any manner it deems fit. Intellectual Property in any such material remains the sole property of Dabur.
8. Personal Information and Privacy Policy:
a. When You participate in the Offer, Dabur/Business Partner collect, receive, possess, use, store, handle, transfer, process and otherwise deal with personal information which is provided by You. This information may vary but will typically include information like first and last name, mailing address, complete date of birth, e-mail address, contact number, account details, UPI details, identity verification documents and details therein and any other personal and/or sensitive information. While doing so we collect, receive, possess, use, store, handle, process and deal with personal information from You that We consider necessary for the purposes of the Offer.
b. You shall be responsible for entering/providing correcting and complete information while participating in the campaign.
c. By participating in the Offer and/ or by providing Your information, You explicitly grant your consent to Dabur India Limited and/or its service provider/Offer partner to the collection, receiving, possession, use, storage, dealing, processing, sharing and handling of the information including personal information You disclose to Us.
d. Please also visit the Privacy Notice of Dabur the Offer Home Page where these T&Cs are posted, to understand and acknowledge what we do with your information including your personal data. Please note that your acceptance of these terms and conditions and Your participation in the Offer and/ or providing the information is deemed to signify your agreement to the Privacy Notice as well and the necessary consent to what could be done with the information including personal data You provide as described in the Privacy Notice.
e. Participants who have won any Offer under the Offer (“Offer Winners”) may be contacted by the Business Partner for collection of further details to ensure delivery of the Offer(s) and the Offer(s) shall only be provided if the necessary information as requested for by the Business Partner has been provided. The Participant shall be solely responsible for any errors in such information provided.
f. We reserve the right to refuse to issue Offers to the Offer Winners unless they provide their information necessary to release the Offer and to perform other activities applicable under the law.
g. Participants hereby authorize Dabur and/or Business Partner to use the personal data shared in connection with the Offer.
h. By participating in this Offer, You also hereby give your consent to Dabur and/or any other third party nominated to carry out profiling of your anonymized data made available through Business Partner. Business Partner will take the necessary measures to secure and keep safe, either directly or through third parties, any such information that You may have shared.
i. It is important to remember that whatever You transmit or disclose can be collected and used by others or unlawfully intercepted by third parties. No data transmission can be guaranteed to be 100% secure. While we strive to use commercially reasonable means to protect Your information, We cannot warrant the security of any information You transmit to Us.
j. Your personal information may be retained and may continue to be used until: (i) the relevant purposes for the use of Your information described in this clause are no longer applicable; and (ii) We and/or Business Partners are no longer required by applicable law, regulations, contractual obligations or legitimate business purposes to retain Your personal information and the retention of Your personal information is not required for the establishment, exercise or defence of any legal claim.
9. Publicity
a. The Participant/s undertake and irrevocably and unconditionally permit Dabur and its Business Partner to cover the Contest through various media including newspapers, radio television news channels, internet, point of sale materials, etc., and shall not raise any objection, protest or demur to such coverage or in this regard.
b. The winners must, at the request of Dabur, participate in all promotional activity (such as publicity and photography) surrounding the winning of the prize, free of charge, and they consent to Dabur using their name and image in promotional material.
10. Force Majeure:
This Offer is subject to force majeure circumstances including without limitation, floods, natural disasters, pandemic, epidemic, government notifications, war, act of terror, political unrests, technical snags, lockdowns or related restrictions, act of God or any circumstance beyond the reasonable control of Dabur and/or Business Partner ("Force Majeure Event"). We and/or Business Partner shall not be liable for any delay or adverse effect caused to the Participants in the Offer including the Offer Winner as a result of a Force Majeure Event.
11. Governing Law and Jurisdiction:
The courts of competent jurisdiction at New Delhi shall have sole and exclusive jurisdiction to determine any and all disputes arising out of, or in connection with the Offer. Participation in the Offer is unauthorized in any jurisdiction that does not give effect to all provisions of these T&Cs, including (without limitation) this clause.
12. Severability:
If any provision of these T&Cs is determined to be invalid or unenforceable in whole or in part, such invalidity or unenforceability shall attach only to such provision or part of such provision and the remaining part of such provision and all other provisions of these T&Cs shall continue to be in full force and effect.

General Terms and Conditions and How to Participate in the Offer
General Terms and Conditions
a. By participating in this contest, Participants fully and unconditionally agree to and accept these Terms and Conditions available on www.daburherbal.bigcityexperience.com ("Contest Website")
b. This Voucher entitles you to an assured cashback of Rs. 20.
c. The usage of this Voucher is incumbent upon the terms & Conditions to be followed by the voucher holder/purchaser. Such Conditions need to be followed by the voucher holder/purchaser.
d. A maximum of one voucher can be used per person, per mobile number, per email ID, per account during the promotion period.
e. This offer is subject to promotional availability and government regulations.
f. This voucher has no monetary value, is non-transferable and cannot be used in conjunction with any other promotional offer.
g. Dabur and/or its Business Partner shall have no legal and financial liability on unclaimed offers, vouchers, etc beyond the applicable period of the promotional offer.
h. Any participant can stand a chance to win only once during the contest period with the same mobile number and email ID.
i. From the Valid Entries received, 10 winners will be selected by using randomizer software based on the valid Unique Code + Unique mobile number.
i. Every week one winner, total 8 winners will be selected from Kerala to win Rs 10,000 Gold eGift Voucher.
ii. Every month one winner, total 2 winners will be selected from Kerala to win upto Rs 1,00,000 Gold eGift Voucher.
j. Prizes will be given subject to the winner satisfying the verification process of Dabur.
k. The Prize (including any merchandise) is provided on an "as-is" basis without warranties of any kind, either express or implied, including without limitation warranties of quality, suitability, or comfort or implied warranties of merchantability or fitness for a particular purpose.
l. The Dabur and/or Partner Agency shall not be liable for any kind of defect or deficiency in the Prize. If any Winner has any grievance with respect to the Prizes, the Winner shall directly contact the manufacturer or supplier.
m. The image of the prize depicted on the press ads/posters/TVC's/pack shots etc. are for illustrative purposes only and the actual prize may vary from the depiction made.
n. The winner will receive the prize details along with the redemption link to claim the prize via SMS and email.
o. No prize will be awarded if the information presented by the Participant(s) at the time of entering the contest is not factually correct.
p. The prize is non-transferable, cannot be exchanged for cash, and must be accepted as awarded. If the winner fails to claim the prize within the specified time and manner, the prize will be forfeited, and no cash alternative will be provided. Prizes must be accepted as offered and cannot be altered.
q. In the event of death of the Confirmed Winner, no claim from the nominee or his/her legal heirs of the Confirmed Winner shall be entertained for receiving the prize.
r. In the event the shortlisted Winner's number is busy, unreachable, or he/she does not attend the call, upto two (2) more attempts will be made to reach the Participant on their winning mobile number. If even on the third attempt, the Participant does not attend the call, or is unreachable, the Participant's participation in the Contest comes to an end and the Participant's entry shall stand canceled/forfeited and the Participant becomes ineligible to receive the prize.
s. Additional Terms and Conditions for Gold Gift Voucher Winners
i. This Gift Voucher is only entitled to a credit to the extent of the face value of the voucher.
ii. If the value of the purchase is less than the value of the Gift Voucher, the balance is non-refundable.
iii. The Gift Vouchers are valid for a maximum of 6 months from the date of issuance by the brand.
iv. No replacement or compensation is permissible for lost or mutilated or defaced Gift Voucher.
v. Gift Voucher can be combined with other ongoing offers at brand stores.
vi. Customers are required to bring along Photo ID proof (with address) for redeeming the Gift Voucher. One of the below mentioned ID proofs will be valid –

How to Participate:
1. Each participant is allowed to enter once using a mobile number throughout the duration of the contest.
2. Participants will be required to register on the contest website www.daburherbal.bigcityexperience.com during the contest period.
3. Participants will enter a unique code along with other details to submit their registration.
1. The Promotion is only valid for you/participant (“You”) who purchase the Dabur Herbal Toothpaste 100g from any of the dealer outlets (“Stores”) authorized by Dabur India Limited (‘’Company’’) across India between 1st July, 2024 to 30th August, 2024 (both dates inclusive) (“Offer Period”).
2. The eligible customers shall stand a chance to receive assured Cashback (“Cashback”) in their bank account/Amazon Pay GV worth minimum Rs. 20/- and maximum Rs. 20/- and as per the terms of the Promotion.
To receive the Cash Code, you must follow the below written steps:

Step 2: You will receive a reward code and weblink (“Weblink”) via SMS within 24 business hours.
Step 3: Visit weblink to enter their mobile number. This mobile number will be OTP verified. You have to also enter their full name and valid email address (“Required Details”).
Step 4: Choose preferred payment method and enter details to submit registration.
2. Steps to redeem the Gold Gift Voucher
a. Walk into the brand store.
b. Select the applicable brand product, based on the Gift card type (refer terms & conditions).
c. At the Billing Counter, inform the cashier about the choice of making payment using Gift Cards.
3. Cashier selects Gift Card as payment mode, submits Gift Card & PIN details in the system and completes the billing process
